PROCLAMATION
I, George the First, Prince of Carmont,
Mindful of the enduring character of Carmont and of my duty to preserve its sovereignty, prosperity, liberty and peace;
Recognising that the State exists for the preservation and advancement of the Carmontian people, and that the authority of the Crown carries with it a solemn duty of service;
Desiring that the government of Carmont shall be conducted with justice, dignity, prudence and fidelity to the laws of the Principality;
Do hereby establish and promulgate this Constitution as the supreme law of the Principality of Carmont.
The Crown, the State and the people shall be bound by its provisions, and all authority exercised within Carmont shall derive from and be exercised in accordance with this Constitution.
TITLE I
THE PRINCIPALITY
Provision 1. The Principality of Carmont is a sovereign and independent state.
Provision 2. The sovereignty of Carmont resides in the Crown and is exercised by the Prince in accordance with this Constitution.
Provision 3. The institutions of the State shall exist for the preservation of the sovereignty, security, prosperity and good order of Carmont.
Provision 4. The official currency of the Principality shall be the Carmontian Shilling.
Provision 5. The national symbols of Carmont shall be established and protected by law.
Provision 6. The City of Montfort shall serve as the capital of the Principality and the principal seat of the Crown and Government. The principal institutions of the State shall be established therein unless otherwise provided by law.
TITLE II
THE CROWN AND THE PRINCE
Provision 1. The Prince of Carmont shall be the Head of State and the supreme constitutional authority of the Principality.
Provision 2. The person of the Prince shall embody the continuity and sovereignty of the Carmontian State. The Prince shall preserve the Constitution, safeguard the independence of the Principality, protect the lawful rights of its subjects and uphold the dignity and interests of Carmont.
Provision 3. The executive authority of the Principality shall be vested in the Prince and exercised by him directly or through officers and ministers appointed under his authority.
Provision 4. The legislative authority of the Principality shall be exercised by the Prince together with the elected Legislature established by this Constitution. No Act of the Legislature shall possess the force of law without the assent of the Prince.
Provision 5. The judicial authority of the Principality shall be exercised in the name of the Prince through such courts and judges as are established by law.
Provision 6. The Prince shall appoint ministers, judges and other principal officers of State upon the recommendation of his ministers where such recommendation is required by this Constitution. The Prince shall not be bound to accept any such recommendation.
Provision 7. The Prince may dismiss any minister or principal officer appointed by the Crown.
Provision 8. The Prince shall exercise the Prerogative of the Crown with prudence, justice and fidelity to this Constitution, and shall at all times act to the best of his ability for the preservation and advancement of the Principality.
TITLE III
THE EXECUTIVE GOVERNMENT
Provision 1. The executive government of Carmont shall be conducted by the Prince and the Council of State.
Provision 2. The Council of State shall be the principal body through which the ministers of the Crown shall advise the Prince and administer the affairs of the Principality and will be chaired by the Prince.
Provision 3. The Council of State shall be organised by the Lord Chancellor, who shall serve as the principal minister of the Crown and shall coordinate the business of the Government.
Provision 4. The Prince shall appoint the Lord Chancellor and such other ministers as may be required for the proper administration of the State.
Provision 5. Among the principal officers of State shall be:
The Lord Chancellor.
The Lord Treasurer.
The Lord Justice.
Provision 6. The Lord Treasurer shall administer the finances of the Principality, subject to the authority of the Prince and the provisions of this Constitution.
Provision 7. The Lord Justice shall be the principal minister responsible for the administration of justice within the Principality, subject to the constitutional authority of the Prince.
Provision 8. The Prince may establish, abolish or alter such offices and departments of State as he considers necessary, subject to the provisions of this Constitution.
Provision 9. The Prince may issue Directorates for the direction and administration of the Executive Government. Directorates shall have such force and effect as may be prescribed by Constitutional Statute.
TITLE IV
THE LEGISLATURE
Provision 1. The Estates-General will serve as the elected advisory Legislature of the Principality, representing the citizens of Carmont.
Provision 2. The Estates-General shall have authority to debate and propose laws, scrutinise the administration of the State, examine public finances and make recommendations to the Prince and Council of State concerning the governance of the Principality.
Provision 3. The Estates-General shall be subordinate to the constitutional authority and Prerogative of the Prince.
Provision 4. The manner of election, composition and procedure of the Legislature shall be established by Constitutional Statute.
Provision 5. The Estates-General may recommend persons for appointment as ministers and judges. The Prince may accept or refuse such recommendations at his discretion.
Provision 6. No alteration to the rates of taxation imposed upon the citizens of Carmont shall take effect upon the sole authority of the Prince. Any such alteration shall require the approval of the Estates-General and the Council of State.
Provision 7. The Estates-General shall not exercise authority contrary to this Constitution or any lawful exercise of the Prerogative of the Crown.
Provision 8. The Estates-General shall not constitute a sovereign legislative chamber. Bills approved by the Estates-General shall be submitted for consideration by the Council of State and thereafter to the Prince for assent or refusal in accordance with this Constitution.
TITLE V
THE JUDICIARY
Provision 1. Justice shall be administered in the name of the Prince.
Provision 2. The courts of Carmont shall have authority to hear and determine matters arising under the laws of the Principality.
Provision 3. Every subject shall have the right to appear before a court of law and to defend himself or herself against any accusation or claim brought before the courts.
Provision 4. No person shall be deprived of liberty, property or other lawful rights except by due process of law.
Provision 5. Judges shall be appointed by the Prince upon recommendation of the Lord Justice. The Prince shall retain the right to refuse any recommendation.
Provision 6. The courts shall administer justice impartially and in accordance with this Constitution and the laws of Carmont.
TITLE VI
THE RIGHTS OF THE SUBJECTS
Provision 1. All subjects of Carmont shall be equal before the law.
Provision 2. Every subject shall enjoy freedom of speech and expression, subject only to such restrictions as may be established by law for the protection of public order, national security or the lawful rights of others.
Provision 3. Every subject shall possess the right to own, possess and enjoy property in accordance with the laws of the Principality.
Provision 4. No subject shall be arbitrarily deprived of property.
Provision 5. Every subject shall be entitled to due process of law and to a fair hearing before a competent court.
Provision 6. The rights granted by this Constitution shall be protected by the Crown and respected by all institutions of the State.
Provision 7. The subjects of Carmont owe loyalty to the Principality and fidelity to the Crown. Such loyalty shall constitute a civic duty and shall be exercised in accordance with the laws of Carmont.
TITLE VII
THE CROWN FORCES
Provision 1. The Prince shall be the supreme commander of the Crown Forces of Carmont, and shall hold the rank of Captain-of-the-Guard.
Provision 2. The Prince shall possess ultimate authority over the organisation, command and employment of the Crown Forces.
Provision 3. The Crown Forces shall defend the sovereignty, independence and territorial integrity of the Principality and shall remain subject to the Constitution and laws of Carmont.
Provision 4. No crown force of Carmont shall act against the lawful authority of the Crown or the constitutional order of the Principality.
TITLE VIII
THE TREASURY AND PUBLIC FINANCES
Provision 1. The Prince shall delegate the Lord Treasurer to administer public finances in his name.
Provision 2. Public funds shall be administered responsibly, economically and for the benefit of the Principality.
Provision 3. The Government shall maintain the greatest practicable transparency concerning the collection and expenditure of public funds.
Provision 4. The rates of taxation shall be established and altered in accordance with Article IV of this Constitution.
Provision 5. No public expenditure shall be concealed from the lawful scrutiny of the institutions of the State except where necessary for the protection of national security.
TITLE IX
FOREIGN RELATIONS
Provision 1. The Prince shall be the supreme authority in matters concerning the foreign relations of Carmont.
Provision 2. The Prince may recognise foreign states and governments, establish diplomatic relations and receive or appoint diplomatic representatives.
Provision 3. The Prince may conclude treaties, agreements and other instruments of international cooperation on behalf of the Principality.
Provision 4. The Foreign Secretary shall conduct the ordinary business of foreign relations under the authority and direction of the Prince.
Provision 5. Carmont shall seek peaceful and mutually beneficial relations with foreign nations and shall conduct its diplomacy with dignity, good faith and respect for the sovereignty of other states.
TITLE X
SUCCESSION TO THE CROWN
Provision 1. The Crown of Carmont shall be hereditary.
Provision 2. Upon the death or abdication of the reigning Prince, the Crown shall pass to his eldest son.
Provision 3. Where the reigning Prince dies without a son, succession shall pass to the nearest eligible heir of the House of Carmont according to the law of succession.
Provision 4. If the successor to the Crown is below the age established by law for the exercise of the full powers of the Crown, a Regency shall be established.
Provision 5. Where the Prince is incapable of exercising the functions of his office through illness, incapacity or other circumstances, a Regency may be established for the duration of such incapacity.
Provision 6. The Regent shall be the nearest eligible relative of the Prince who has attained the required age.
Provision 7. The Regent shall exercise the powers of the Crown solely for the preservation and proper administration of the Principality and shall surrender the Regency immediately upon the sovereign attaining the required age or recovering the capacity to exercise the office.
Provision 8. Where no viable heir exists under the ordinary rules of succession, the Prince shall have the authority to appoint a successor to the Crown.
TITLE XI
THE SUPREMACY OF THE CONSTITUTION
Provision 1. This Constitution shall be the supreme law of the Principality of Carmont.
Provision 2. Every institution, officer and subject of Carmont shall be bound by this Constitution.
Provision 3. No law, decree, order or exercise of public authority shall possess legal force insofar as it is contrary to this Constitution.
Provision 4. The Prince, as guardian and executor of this Constitution, shall ensure its faithful observance.
TITLE XII
AMENDMENT OF THE CONSTITUTION
Provision 1. Amendments to this Constitution may be proposed by the Prince or by the Legislature.
Provision 2. No amendment shall take effect without the assent of the Prince.
Provision 3. The procedure by which amendments are proposed, debated and approved shall be established by law, provided that no amendment may abolish the sovereignty of Carmont or the hereditary Crown except by an instrument expressly establishing a new constitutional order.
Provision 4. Amendments to this Constitution may be proposed by the Estates-General or the Council of State. No amendment shall have force or effect unless it has received the approval of a majority of the Estates-General, the approval of a majority of the Council of State, and the assent of the Prince.
Provision 5. No amendment shall diminish the fundamental rights and liberties guaranteed to the Subjects of Carmont, nor shall any amendment alter the hereditary nature of the Crown, except by the express consent of the Prince and the Council of State acting in accordance with this Constitution.
TITLE XIII
FINAL PROVISIONS
Provision 1. The institutions of Carmont shall at all times conduct themselves in accordance with the principles of justice, continuity, national sovereignty and service to the Principality.
Provision 2. Nothing in this Constitution shall be interpreted as diminishing the duty of the Prince to preserve the peace, independence, prosperity and lawful order of Carmont.
Provision 3. The Prince shall uphold this Constitution according to his conscience and ability, and shall exercise the Prerogative of the Crown not for personal enrichment or arbitrary domination, but for the preservation and advancement of the State entrusted to his Crown.
Provision 4. This Constitution shall enter into force upon its promulgation by the Prince.
